In order to prevent and resolve risks and strengthen integrity measures, the Municipal Commission of Housing and Urban Rural Development recently issued the Notice on Regulating the Work Related to the Reorganization, Merger and Division of the Qualification of Construction Enterprises (hereinafter referred to as the “Notice”), which makes new requirements for the work related to the reorganization, merger and division of the qualification of construction enterprises (including construction and supervision enterprises), Enterprises with qualifications (hereinafter referred to as “new enterprises”) and enterprises with qualifications (hereinafter referred to as “original enterprises”) jointly prepare application materials and submit applications according to the following requirements.
If the qualification of our city is transferred across provinces, the Municipal Commission of Housing and Urban Rural Development shall send a letter to the provincial competent department of housing and urban and rural construction for consultation.
If the new enterprise belongs to the city, the new enterprise shall initiate the application process; If the new enterprise is outside the city, the original enterprise shall initiate the application process.

After the enterprise application is approved, the qualification deleted by the original enterprise will not be restored.
If it is found that the requirements of qualification standards are not met, a one month adjustment period will be given; If the requirements of qualification standards are still not met after rectification, the corresponding qualification obtained shall be revoked.
The original enterprise and the new enterprise (hereinafter referred to as “the enterprises of both parties”) shall not engage in the purchase and sale of qualifications in violation of laws and regulations, and shall jointly bear legal responsibility for the authenticity of the application materials.

The handling personnel of the enterprise shall be the regular employees of the enterprise who pay social insurance.

In principle, the corresponding qualification shall not be applied again according to the relevant conditions.
The competent departments of housing and urban and rural construction at all levels shall verify the identity of the person in charge of the enterprise when accepting the application of the enterprise.

If the new enterprise belongs to the city, it will be included in the one-year key verification period.
If the enterprise fails to maintain the parent subsidiary relationship for at least three years as promised, the qualification obtained by the new enterprise shall be cancelled.
If a new enterprise belongs to the city and changes its shareholders and legal representatives during the key verification period, it shall be included in the key verification objects within three years after approval.
If the enterprise application is not approved, the original enterprise and the new enterprise shall not apply for reorganization, merger or division again within six months in principle.

If the new enterprise is outside the city, it can be accepted only after receiving the letter from the provincial competent department of housing and urban and rural construction approving the transfer of qualification (except for the qualification approved by the Ministry of Housing and Urban Rural Development).
The qualification of accepting municipal approval (including the pilot qualification of our city delegated by the Ministry of Housing and Urban Rural Development) shall be accepted by the Municipal Commission of Housing and Urban Rural Development; The qualification approved by the district/county (including the qualification approved by the district/county under the authority of the Municipal Commission of Housing and Urban Rural Development) shall be accepted by the district/county competent department of housing and urban and rural construction.
The enterprise logs into the “Yukuaiban” website of Chongqing Municipal People’s Government, enters the construction enterprise qualification management system, carefully reads the application notice, fills in the application commitment letter, and uploads through the system together with the attachment materials according to the requirements of the Notice and the work guide, without submitting paper materials.
